This dissertation contains an analytical study of provisions relating to unfair competition in the Omani Law compared with other laws. Unfair competition pertains to every act by a merchant while practicing his commercial activity that is contrary to honest principles traditions of commercial work. Regulating competition has great importance in protecting merchants from the damages that may afflict them commercially. Regulation also has financially an important role in protecting the consumer who deals with the merchant such against being subjected to commercial fraud as a result of the unfair competition of another competing merchant.
The Omani legislator has regulated the provisions of unfair competition through the commercial law issued by Royal Decree no. 55/1990 AD and the Law on Industrial Property Rights issued by Royal Decree no. 67/2008 AD, which replaced certain laws that were regulating the provisions of unfair competition. These laws have been addressed in the thesis so as to compare them with the Law on Industrial Property Rights no. 67/2008.
The study concluded that certain provision cited by the Omani legislator in the laws were not sufficient to regulate this matter. In addition, these texts were not clear enough to find suitable solutions for many ambiguities that were raised through judicial controversy. At the end of this study, certain results and recommendations are suggested to solve these ambiguities.
