Contaminated blood transfusions have raised and continue to pose many problems in various fields, in the legal framework in particular, especially the extent to which the Penal Code is appropriate for its traditional crimes to confront new forms of harmful behavior that the legislator has not previously known. One of the most prominent problems in this field is the difficulty of giving the legal description and appropriate criminal adaptation to the different forms of behavior that transmit intentionally or negligently, and on the other hand, blood transfusion is the most important method for a person?s blood to communicate with another person?s blood. Therefore, it must be legitimate and regulated by legal rules, this is what is stipulated in most of the legislation.
The importance of this topic and the reason for our choosing it is evident in its recentness, the lack of previous study of it in the explanations of the Penal Code or the special penal laws, and our attempt to address the problematic of research, or as a minimum to raise this problem on a large scale. It may be a motive for the Omani legislature to enact legislation on blood transfusion and impose protection on human blood from contamination.
This study is to answer a number of questions through an introductory study in which we will talk about what blood is, and about the process of blood transfusion. The first chapter deals with the position of legislation on the process of blood transfusion which is divided into two parts; first of which we will address the position of international and regional legislation, and the second we will talk about Omani legislation position. The second chapter addresses the forms of criminal responsibility for transfusions of contaminated blood which is also divided into two sections; images of intentional crimes and their unintentional forms
