This thesis aims at acquainting the protection bestowed by the Omani Legislator on industrial designs and state points of strength & weakness in the Omani Law and increase the awareness of industrial designs importance by replying the following questions:
1. What is the definition of industrial design?
2. What are the conditions that must be available to protect the industrial design?
3. What protection bestowed by the Omani Legislator on industrial designs?
To answer these questions, the thesis was divided into 4 chapters including the preliminary chapter which includes two researches. The first research shows what is industrial design and its legal nature and in the second research the discrimination of the industrial designing from the elements of the other intellectual property. The first chapter the proprietor of industrial design rights and commitments has been clarified. The first research the rights of the owner of the industrial design and in the second research the commitments of the owner of the industrial design . The second chapter includes the conditions which must be available for the protection of industrial design. It includes two researches the first one stated the subjective conditions and the second includes the formal conditions. Then the legal protection of industrial design in its two parts the civil and penal were clarified in chapter three which includes two researches as the first research includes the civil protection of industrial design and the second research includes penal protection of industrial design. At end of the thesis many proposals were presented regarding the legal protection of industrial design.
