The researcher preferred the study of legal protection for trademarks, due to lack of studies on this subject according the recent Gulf Law of 2017, In addition, the dumping of counterfeit and fake trademarked products on the market and the lack of legal awareness among the public and merchants as well.
This study aims to investigate the legal protection of trademarks in both its civil and penal aspects. This study has been divided into three chapters, the introductory chapter deals with the basics that relate to the study, such as the definition, significance and types of trademarks, while the first chapter has been devoted to explore trademarks that are subjected to legal protection and those excluded from it, meanwhile, the second and final chapters are concerned with civil and penal protection of the trademark,the first of which is devoted to civil protection by addressing the claims for compensation, deletion, confiscation and destruction of goods and the period of protection of this mark.Chapter two deals with penal protection through the narrative of crimes committed upon and the legally established penalties for such crimes.
The study adopted the GCC trademark (System) Law for Gulf Cooperation Council states approved by Royal Decree No. 33/2017, as well as the Omani Industrial Property Law issued by Royal Decree No. 67/2008, as the focus of this study.
The study was concluded with a set of results and recommendations, summarizing that Gulf Trademark Law defined the trademark, procedures and conditions for registering the trademark, as well as criminal protection was limited to registered trademarks only and other results, the researcher has connected several recommendations, including that explicit protection of unregistered trademarks should be provided, as well as the establishment of intellectual property courts and the training of its cadres, and to work to increase customs control to prevent the entry of counterfeit or fake goods and other recommendations that we hope will be benefit to those interested in the development and study of this law.
