This study aims to introduce the legal procedures of patents in the Omani Law by researching the required procedures to gain a patent, and identifies the protection the Omani Legislator offers to patents. These objectives are achieved by answering the following questions:
-What is The definition of Patent? What are its nature and types?
- What are the legal conditions and procedures that must be available to grant a patent?
- What are the rights and responsibilities that result from granting a patent?
- What is the legal protection that the Omani Legislator offers to a patent?
These questions are discussed in two entries: the first entry is designated to discuss the definition, conditions and procedures of granting a patent. It is divided into two chapters. The first chapter contains two main parts; 1) the Definition of a Patent and its nature; 2) the types of a patent, The second chapter explores the conditions and procedures that must be available to grant a patent. Thus, it consists of two parts; the first one deals with the conditions of a patent; the second one discusses the procedures of registering a patent.
The second entry is designated to explore the legal effects that result from granting a patent and its legal protection in two chapters. The first chapter, which deals with the rights and obligations of a patent owner, is divided into three parts; 1) the rights of a patent owner; 2) the obligations of a patent owner; 3) the methods of the expiration of a patent, The second chapter investigates the legal protection of a patent based on two components: civil protection and penal law protection.
