This research aims to shed light on the profession of brokerage and research
within the legal framework of this contract. This was dealt with in detail under Oman
Commercial Law issued by Royal Decree No. (55/90) and the special regulations
governing this profession and some of the principles approved by the Supreme Court
of Oman, considering that the contract of brokerage is one of the important
commercial contracts for the broker's business life.
The idea of this research came from discussing the nature of the brokerage
profession and introducing it as one of the commercial contracts prevailing in most
fields of trade. However, it has not received wide attention in its explanation,
especially by Omani law. The researcher believes it is important to shed light on this
profession and to study its legal aspects.
To achieve this research, the researcher she addressed the subject in three
separate chapters; In the first chapter, the identity of the brokerage contract was
identified in detail in the first section, in terms of its definition, parties and
importance, the second section dealt with the characteristics of the brokerage contract
and touched upon certain types of brokerage contract, such as real estate brokerage,
insurance brokerage, securities brokerage, and the distinction of the contract for other
contracts (the commercial agency contract, the commission contract, the commercial
representation contract). As well as in the third section dealt with the contract of
brokering within the legal framework and its terms and methods of proof.
In chapter II, the researcher dealt with the implications of the contract of
brokerage. In the first section, she addressed the obligations of the broker and the
second section on the obligations of the customer, while in the third section she
discussed the penalty for breach of the contract of brokerage.
The researcher dealt with the end of the brokerage contract in the third and last
chapter, in terms of its elimination by ordinary methods in the first section and
extraordinary methods in the second section.
