The Omani penal legislator has alerted the seriousness of the crime of
misleading justice to the judiciary system and society, and addressed the
phenomenon of increasing the practice of these criminal acts. Therefore, the new
Omani Penal Code, issued by Royal Decree No. (7/2018), introduced new
articles dealing with the different forms of the crime of misleading justice.
Complementing the role of the penal legislator in confronting the crime of
misleading justice, this study aimed to explore the depths of the crime of
misleading justice and its nature, by standing on its definition, clarifying its pillars,
and covering most of its forms. The cure for this disease can be in the pursuit of
a precautionary and preventive policy that protects justice and society from the
deception acts and fights the same before occurring. In addition, knowing the
nature of this crime effectively contributes to alerting the judiciary system with the
numerous misleading forms and actions as they are difficult to detect.
This study required an introductory research that defines the crime of misleading
justice and its historical framework, then divides it into two chapters. The first
reviews the legal structure of the crime of misleading justice, and the second
shows the implications of establishing criminal liability for the crime of misleading
justice.
