The Omani legislator is keen to provide criminal protection for women from all
forms of violence and discrimination. Perhaps the forms of this protection are
reflected in the rights guaranteed by the Constitution for both genders equally, and
the penalties, severe or not, stipulated in the Penal Code, against the perpetrators of
crimes. Oman Laws adopted the approach of imposing penalties against violence
crimes without regard to the gender of the violator, victim or type of relationship
between them in a number of crimes such as crimes committed by successors against
predecessors, and the crime of kidnapping, if the victim was a female. However, the
contemporary legislative understanding has witnessed a development in its
understanding of the special nature of domestic violence crimes against women, and
the impact of the complexities of family relations, culture and prevailing social
customs on achieving justice and protection for women from domestic violence
crimes. Consequently, the non-adoption of positive discrimination in defining
crimes of domestic violence, severing their penalties, and enacting special protection
mechanisms and measures has become one of the legislative shortcomings in the
penal protection of women from domestic violence crimes.
In her study, the researcher followed the comparative-analytical descriptive
approach, where she dealt in the introduction with the statement of the nature of
domestic violence against women, and devoted the first chapter to shed light on the
position of Omani legislator to domestic violence crimes against women
In conclusion, the researcher concluded with a number of recommendations that
would enhance the penal protection of women from domestic violence crimes in the
Omani legislation by deriving the legal model for crimes of domestic violence
against women from the penal texts for violent crimes, analyzing them and
comparing them with similar comparative laws, and finally studying the Gulf and
Arab laws on protection from domestic violence, in an effort to find ways to enhance
the penal protection of women from crimes of domestic violence in the Omani
legislation.
In conclusion, the researcher included the significant results and recommendations.
