This study deals with the issue of arbitration between spouses during the
absence of the Shari'ah judiciary because of its importance in meeting the
rights of people and achieving justice for them according to the Shari'ah
approach. The study also dealt with the conditions of the arbitrators and
the mechanism of their selection, the arbitration procedures followed by
them, and the mandatory arbitrator's ruling, as well as a statement of the
jurists' statements in matters of arbitration between spouses .
It was found that arbitration between spouses is one of the important issues
in jurisprudence legislation and that the goal of the work of the two
arbitrators is to reform and reconcile the spouses first, but circumstances
may occur that make it most suitable to differentiate between the spouses,
and it was also found that the arbitration process is carried out according
to certain procedures from its beginning to its end .
The study concluded that arbitration is a method known before Islam to
settle disputes and is approved by Islam, and it is considered one of the
most important contemporary means now .Some cases in which the
spouses are separated by the arbitrator were discussed.
