This research aims to study the effects of emergency conditions
on banking leasing contracts of its three types: operational leasing,
leasing ending with ownership, and iron safes leasing. And an
explanation of who is responsible for the loss of the leased property in
the emergency situation, and who bears the harm of not fulfilling the
benefit.
I have followed the inductive approach in this research by collecting and
extrapolating what was written about bank leasing from the books of
contemporary scholars, and took the comparative approach, and
mentioned the sayings of scholars and their evidence in issues of
emergency circumstances, and the discussions they cited in these
issues, with weighting as much as possible, and perhaps one of the
most important The results of the research are that emergency
circumstances may respond to the contract and dissolve it from its
origin, such as the total destruction of the leased property, and the
contract with it may remain as the destruction of the property described
in the sukuk.
