الملخص الإنجليزي
In the new Foreign Capital Investment Law, the Omani legislator provides the foreign investor with many legislative guarantees against non-commercial risks, whether they are related to the ownership of his investment project or his activity. Such legislative guarantees assist the foreign investor in overcoming non-commercial risks facing his project and removing any doubts in his mind that undertaking an investment activity in the Sultanate involves many non-commercial risks that he has no control over or considered when undertaking such investment. This research paper seeks to focus on the nature and reality of such guarantees on one hand, and answer many questions on the other hand, including:
1-Are these guarantees, in their current arrangement, sufficient to face such risks and their repercussions? Or should they be re arranged more effectively than they are now?
2-To what extent the legislator, while providing such guarantees, was able to reconcile what is required by the national interest of the Sultanate with the interests of foreign investors.
