The following paper investigates the nature of Electronic Contracts and the extent to which they could be considered as compliance contracts. Accordingly, the road map of the paper will be divided into one introductory and two main sections. The introductory section deals with the definition of electronic contracts in international covenants and national legislations including Qatari legislations. The First section then examines the traditional trend in jurisprudence that rejects the idea of qualifying Electronic contracts as compliance contracts, viewing them instead as bargaining contracts. In the second section, we address the modern trend in jurisprudence that expands the concept of compliance contracts and acknowledges electronic contracts as a form of such contracts. We further highlight in this section the impact of considering the electronic contract as a compliance contract on the electronic contractor as a compliant party who must be protected from arbitrary clauses.
The paper then concludes with highlighting the importance of treating electronic contracts as a form of compliance contracts. It further stressed upon the need to educate contracting consumers via the Internet, and the existence of great importance for organizing the issue of drafting electronic contracts in international agreements.
