The current economic and industrial transformation of the world, and the consequent rapid developments in business and industrial activities, in order to ensure the sustainable development of the members of society, makes many businessmen and industrial enterprises need to use the environment surrounding these works and industries, so that such use is legitimate in the need for legal regulation corresponding to the size of those uses that may affect human life and the safety of society. It can be said that the issue of saving the environment has become the most human challenges at the present time, especially in the light of successive economic developments, which in one way or another affect the environment by the damage caused by factories and companies, often the environmental pollution may affect the environment and endanger human life. Hence, the role of the criminal law is vested in the report on the criminal protection of the environment as the law that expresses the most basic expression of fundamental social interests and values, which requires that it be considered an offense punishable under criminal law with penalties for deprivation of liberty or financial fines and other penalties, whether the attack is to pollute the environment and the sources of life therein, or through the circulation of hazardous materials and wastes, discharge or dumping environment.
