One of the most prominent reasons for gaining real estate ownership is possession, provided
that the holder’s possession of the property expires for a certain period specified by law in
order for him to gain ownership of the property and issue an official title deed to him.
The study aims to know the position of the Omani legislation and judiciary compared to
other legislation in adopting aerial photographs as a modern means of proving the statute
of limitations for real estate ownership, with a comparative analytical approach, based on
the analysis of legal texts and rulings issued in real estate ownership claims by possession,
with the position of the courts. Cassation and discrimination in comparative judiciary in this
regard, and to ensure reaching this goal, this must have been preceded by an explanation
of the concept of real estate ownership, the reasons for gaining it by possession of the
property, and the relationship of the statute of limitations to gaining ownership of the
property, followed by a discussion of the general methods of proof, both ordinary and
modern. In proving possession, then going into an explanation of the concept of aerial
photographs, their nature and uses.
One of the most important results of the study was the difference in the position of the
Omani legislation and civil judiciary with the comparative legislation and judiciary in the
mechanism of proving the statute of limitations for possession of real estate. The Omani
judiciary sees the necessity of following normal methods of proof such as written evidence,
witnesses, evidence, etc., unlike the comparative legislation that showed flexibility in the
possibility of resorting to means. Modern sources, such as aerial photographs. The study
recommended that the Omani legislator should exert great interest in filling the legislative
shortcomings related to this issue, and benefit from comparative legislation that takes aerial
photographs into evidence, with the necessity of creating an official unified database for
aerial photographs, to be a reference for those concerned. Judicial authorities may rely on
it in order to compare their data with what is revealed by normal means of proof, such as
