The purpose of this study is to highlight the challenges in the legislative organization and practical application of electronic judicial notification and suggest appropriate solutions to decrease their impact. The core of this research is the gap between the legislative regulation of electronic judicial notification and its practical application, which resulted in several problems that prevented electronic judicial notification from achieving its goals as the legislator planned.
This study includes an introductory section in addition to two chapters. The introductory section talks about the nature of electronic judicial notification. The first chapter examines the procedural regulation of electronic judicial notification in Omani law. The second chapter contains the problems that the researcher observed in the legislative organization and judicial application and how they affect lawsuit procedures.
This study was carried out by following the descriptive analytical methodology, which is based on researching and analyzing the legal text to reach practical solutions to the problems. In addition to extrapolating, tracking, and observing what the Omani legislator and judicial application passed regarding the judicial notification from its traditional inception until its legislation electronically, and criticizing the lack of consistency between theory and application. The most prominent finding of the researcher through this study is that there is a discrepancy between the legislative text and the judicial application of the electronic judicial notification, in addition to the incompleteness of the electronic system from the various authorities in the Sultanate in enhancing the electronic judicial notification process. The researcher urged the legislator to amend the law in relation to the commencement of effect of the electronic notification and urged the various state institutions to cooperate to ensure the development of an integrated system that allows electronic judicial notification to be carried out to the fullest extent.
