Due to the significant gap created by advancements in science and technology, there
is often a lack of understanding between the seller, who is well-versed in the
professional aspects, and the buyer, who may lack the technical knowledge required
to make informed purchasing decisions. Consequently, it has become important for
sellers to guarantee that their products meet the standard specifications and satisfy
the buyer's needs. This guarantee ensures that the buyer has strong legal protection
in traditional contracts. The seller's commitment to adhere to the agreed terms is
essential to a sales contract. This implies that the seller must guarantee that the
delivered item complies with the specifications defined in the contract, whether
explicitly stated or implied. With the increasing prevalence of electronic sales, issues
may arise where the buyer receives goods or services that do not meet their
expectations or the description provided by the seller. In such a case, how should the
problem be resolved? Consequently, the research aims to examine whether the
protection offered to buyers in electronic commerce is proportional to the power
held by electronic sellers, considering their expertise and technical capabilities, as
well as comparing the traditional general and private rules to those outlined in the
Electronic Transactions Law governed by national and regional legislations. The
study used an original and comparative approach to evaluate the adequacy of this
protection and found a legislative gap and a need for specific rules to address the
rapid development of electronic commerce and ensure consumer privacy protection.
