This study describes and analyzes the efforts of Omani legislation in how it
preserves the lives of patients in the field of medical experiments, therapeutic
medical experiments and non-therapeutic (scientific) medical experiments. And
to what extent the Omani legislator included in its texts the protection of the
patient from researchers and doctors who conduct medical experiments on him,
by reviewing the texts of Omani legislation in a number of different laws. The
study also compared the efforts of Omani legislation in the field of medical
experiments with the efforts of some other legislations.
This study focus on analyzing the legal framework that regulates patient
protection in Omani legislation, and focuses on laws related to medical
experiments. Through analyzing legal texts, this study seeks to determine the
efficiency of Omani laws and legislation in providing adequate protection for
participants and patients in the field of medical experiments, through a careful
review of the texts of the law and an assessment of their effectiveness in deterring
those in charge of medical experiments from committing any of the acts

on a somewhat complex legal and ethical dilemma related to protecting the
patient from medical experiments, which is a problem related to the necessary
balance that must exist between the basic rights of the individual and scientific
progress. In light of the rapid and increasing scientific developments, the
importance and necessity of protecting patients and participants from the dangers
of illegal medical experiments lies, thus emerging as a fundamental problem that
needs tangible and clear legal solutions. This study ultimately reached a
fundamental conclusion, which is the deficiency of Omani legislation in
protecting the patient from medical experiments, Because he was not familiar
with all the details of medical experiments in terms of the events and issues that
might occur when conducting medical experiments when he developed the
legislative texts related to them, and the failure of the Omani legislator to
differentiate between therapeutic and non-therapeutic medical experiments, but
rather included both types in a general formula when mentioning the texts of
criminalization and punishment in the Omani laws mentioned in the study. The
study also concluded with a fundamental and important recommendation, which
is the necessity of developing a comprehensive and detailed legislation in its texts
for everything related to medical experiments, distinguishing between therapeutic
and non-therapeutic medical experiments and the provisions of each in terms of
criminalization and punishment.
