This research is concerned with analyzing texts that criminalize the disclosure of the
country's secrets, those contained in Articles (129) to (132) of the Penal Code, and
which the omani legislator has criminalized as intentional behavior, represented in
various conduets, which are: Either surrender or divulge defense secrets, Or obtain ing it in any way with the intent to hand it over or disclose it to a foreign country or
entity, or facilitate obtaining it, or destroy it, or make it unfit for its use. Either the
public servant's disclosure of a defense secret of the country was entrusted to him,
or obtaining it by illegal means without intending to divulge them,or preparing and
using means of communication with the intention of obtaining it. Or broadcasting it.
The Omani legislator was content to criminalize the intentional behavior of the
perpetrator, by which he discloses the secrets of defense of the country, whether in
peacetime or in time of war, without criminalizing the disclosure of these secrets
unintentionaly .
This research is concerned with showing the possibility of achieving it through
unintentional behavior by reviewing the crimes of intentional disclosure of defense
secrets that the Omani legislator has incriminated by describing intentional wrong doing, to show whether he can criminalize them by describing the unintentional
mistake or not, by examining the same acts and analyzing them to show the extent
of their criminalization in agreement with the components or unintentional error,
in terms of stating the will of the perpetrator for his criminal behavior and his
knowledge of his identity, and the necessity of this knowledge on him because of
the danger that his behavior couses to the secretes protacted, which is sufficient to
be criminalized with unintentional error.
