The study highlighted the foundations of a fair trial, which should first be the
ruling body as an independent and impartial authority and specialized judges.
Therefore, the justice of the judiciary is based on these three pillars, as the topic was
studied through three investigations. The third was devoted to the competent natural
judge, and the study reached several results and produced a set of recommendations.
This study relied on the descriptive and analytical approach based on analyzing
the texts and devising their purpose and interpretation in order to arrive at the final
intentions sought by the legislator, in light of Omani and Moroccan law.
