This thesis aims to study the issue of the civil protection of the trademark in Oman Law by analyzing the provisions of the Trademark, Data and Trade Secrets and the protection from the illegal competition, issued by the Royal Decree No. 38 / 2000 and the GCC Trademark System adopted by Royal Decree No. 33 / 2017 and Oman civil Transactions Law through the general rules of responsibility.
To achieve this goal, the thesis was divided into two chapters. The first chapter deals with the Trademarks as a general idea. The first section is dedicated for the definition of the trademark, and the different types and forms, and the distinction between the Trademarks and other similar ones, while the second section dedicated for the Trademarks registration terms and the sequences of the trademark registration, at the third section discuss the infringement of the trademarks.
The second chapter examines the civil protection of the trademark. This chapter was divided into three sections. The first topic address the civil protection of the trademark and its scope, extension and the legal basis. The second topic discuss the procedural protection and protection by eliminating the trademark. The third topic address the civil protection of the famous brand.
The study concluded with a conclusion that included the most important findings and recommendations.
