Fornication is one of the damaging crimes to society due to its violation to the code of public ethics and people's honor. Its damage is not limited to the victim yet it effects the society as a whole, due to its serious corollaries including the distortion of lineages, the dissolution of families and the spread of STDs, hence, in the final result, fornication causes serious moral decay and a negative impact on lineages that is prohibited by Islamic Sharia law, it is not even allowed to be mentioned verbally, therefore, every penal legislature should consider that in the articles of Penal law. All Arab legislation should consider fornication as a crime and should specify its segments and punishments on the fornicators. The aim of this research is to study the crime of fornication under Omani Law by analyzing the articles that Omani legislators composed in the Penal Law and an attempt to analyze the Arabic Legislations to know the ways and method followed in an effort to limit violation of lineages and also an attempt to differentiate fornication from other crimes that violate honor and public ethics The in production for the study is presented by an introductory research in which the researcher discusses the definition of the crime, and whether the crime was referred to clearly by Omani legislators and the elements included and its connection to laws that govern marriage and divorce in the Civil Status Law. Also, the study included the objective laws that included the main premises represented by the financial and moral aspects and their penalties in addition to the approach of legal excuse concerning fornication and the conditional defense associated with it as a crime of fornication. The study also discusses the procedural rules represented by public prosecution for fornication and the related conditions and procedures as well as the methods to prove the crime. The study concluded that the crime of fornication is committed between a man and a woman in way of sexual intercourse and exclusively when vaginal penetration occurs with mutual consent of both parties without the legal bond of marriage. Although the damage is mainly occurs on the victim yet it effects society as a whole, while public prosecution authority in terms of presenting public lawsuit as its original jurisdiction was limited by the Omani legislators by necessitating a lawsuit presented by the victim as per certain procedures and within a limited time table. Recommendations presented at the end of the research as a means to deal with any legislation insufficiency by Omani legislators regarding the crime of fornication.
