This thesis aim to show the legal effects of privatization in the legal system of the Sultanate. It adopted the historical method in showing the emergence and development of privatization idea, and the analytical method by analyzing the provisions of the Privatization Law No. WY.and privatization regulation in the Sultanate promulgated by Royal Decree * 7/1997, The thesis focus on the following issues:
show the historical development of privatization process and its relation to economic reform and the importance the government has attached to the privatization process. Justifications for adopting privatization in the legal systems and the objects to be achieved from such concept.
- Methods applied in privatization in the Sultanate and the various outcomes due to various method applied and the surrounding circumstances. Set out the legal framework resulting from the privatization process such as establishment of the project company, its legal status, establishment procedures and the reasons why the Omani legislature chose it to replace the privatized facility after privatization. Effect or privatization on the national cadres in the projects to be privatized and how the Omani legislature addressed the issue of employees in privatized projects without undermining the success of the privatization process.
The thesis concluded that there are a number of constructive points that show the Omani legislature was able to focus i.e. protection of the employees in the privatized projects and providing for successful privatization process ensuring growth of the national economy and achievement of sustained development in the Sultanate. Though there are positive points in this study on the Privatization Law, however, the researcher sough to bring to the attention of the legislature the significance of reducing the ratio of foreign investment in projects to be privatized and to focus on non-title transferring methods. Finally the study recommended reconsideration of Article Yo of the Privatization law in respect of canceling the percentage imposed by this Article on the increase in the pensions of the employees transferred to the project company.
