English abstract
to the Omani Electronic Tran Transaction Effects of the Electronic Sale Contract study according to the Oman Electronic Transaction Law in the beginning contents of Electronic Sale Contract statement concept and his properties as well as the agreement conditions. This study was concentrated on the obligations of the seller and the buyer in the Electronic Sale Contract where the seller will be obligate by two types of the following obligation:
1-Obligations previous the contract: such as obligate about his id data, vended nature data, receipt way, carrying out facilities.
2- Obligations after the Electronic Sale Contract: and this type of obligations revealed in two parts:
A) Peculiar obligations such as to notify the buyer about fully details of the contract and his commitment to consider the buyer droit in amicability and keeping of his secret data, to esteem his characteristic, the vended safety guarantee and the corresponding to the contract conditions.
B) General commitments such as abalienating of vended asset, receipt, commitment of the exposure and the merit guarantee and the hidden defects guarantee. As the study was contained of the buyer obligate in the Electronic Sale Contract and it was represents in the following two commits: the payment price obligate and the receipt sold obligate. In the ending of this study, we have multiple benefit the important of it is: non systematizing of the Oman Electronic Transaction Law about the obligate of the seller and the buyer in the Electronic Sale Contract by accurate and articulate form, and it contents of multiple proposals the important of it is: addressing of the seller and the buyer obligate in the Electronic Sale Contract according to the Oman Electronic Transaction Law which represents as a maximum importance in the electronic contracts scope.
