English abstract
This dissertation endeavors to review the most vital basis, controls and legal norms valid in the Sultanate of Oman for arbitration pronouncement of judgment and its nullity, through answering a number of questions the most important of which are: 1. What is the term within which the arbitration pronouncement of judgment should be served and how such term could be determined? 2. What are the provisions necessary to the justness of arbitration pronouncement of judgment? 3. What is the effect of arbitration pronouncement of judgment on ending up the arbitrators' mission? 4. What are the reasons leading to file a case regarding nullity of arbitration judgment? 5. What are the necessary legal procedures to file a case regarding nullity of arbitration judgment? And what are the conditions of accepting such a lawsuit? The researcher has studied and analyzed all elements comprised within this dissertation in a way that reflects the most important of these bases, rules and legal controls regarding the arbitration pronouncement of judgment and its nullity, Within the most significant results concluded by this study: 1. The Omani legislator's regulation to arbitration, as corresponding to pronouncement of judgment and its nullity is conforming to a large extent to the standard arbitration law and UNSTRAL laid by the United Nations. 2. This study tended to propose numbering of amendments on the arbitration law in order to plainly cater for the recent legislative imperfection and malfunction, so as not to leave a margin for conflicting interpretations and explanations therein.
