English abstract
God has honored the human and, through his heaven messengers, provided them with whatsoever facilitate them to lead a safe, merry and good life, free of humiliation, hurt, intimidation or torture. On the other hand, all international agreements support the principal of the human dignity through the reverence of all kinds of torture and all countries of the world include that in their national laws in order to safeguard human against any prejudice. For all stated above, the researcher worked hard to clarify the torture crime according to the Omani law and compare the same with some other legislations. This shall be processed by explaining the meaning of torture clarifyingthe main elements of the crime and the resulting responsibilities, in order to achieve high standard quality objectives. Perhaps the most prominent goal of these is to enable and make all the individuals of the Omani society understand and b aware of the torture crime and the consequence material and moral damage. It is also necessary to make them aware of the procedural and legal security guards provided for the accused person through the various the stages of the case so that he could be aware of his legal situation and to keep safe from any type of body harm through torture. In addition to what stated above, it is necessary to urge the concerned authorities who investigate the public case to be committed to the procedural regulations as in the state statuate and in the criminal procedural law. All this is to safeguard the rights and freedom of the accused persons or be subject to any type of force. It is also necessary to explain the responsibilities that rest on whoever violate liberty of the accused by any kind of torture to achieve any deterrence factor. The study also consider the similarities differences in the legalization of the crime of torture in the Omani law and the other laws with the suitable comparison to find out the shortcomings in the Omani laws and the appropriate recommendations to be considered in future by the Omani legislator.
