English abstract
The research discusses the obligation to ensure safety. It is a obligation to know the defects in goods or service and correct it in order to achieve the security expected by the user. The research tried to provide milestones for the general theory of obligation to ensure safety, then apply that to Omani law through two examples. The first example stipulate the need to have obligation to ensure safety in consumption contract, and second is Omani judiciary system need to establish an obligation to ensure safety in some of the medical treatment applications. This is for logical legal and social considerations. The research aims to study the emergence of commitment to ensure safety and its development in jurisprudence, judiciary and legislation system, define this obligation to ensure safety, its content and thing related to it, its future, and how to push it forward in the Omani legal system. The research consists of three chapters and a preliminary study. The preliminary study discussed the issue of obligation to ensure safety in the Arab legal systems. The first chapter has dealt with the essence of obligation to ensure safety and its legal nature, and the second chapter covers the issue of liability arising from a breach of an obligation to ensure safety. The third chapter is devoted to study the applications of obligation to ensure safety in the Omani law.
The research has reached several results, the most important of which is that the Omani Consumer Protection Law imposed on a breach of contractual obligation a responsibility rests on provider in favour of the contractor, and liability in favour of third parties. The legal, logical social considerations call the Omani judiciary system to make doctors obliged to ensure safety in some medical activities, such as blood transfusion.
