English abstract
The study aims researching on the legal system that regulates the electronic Business premises in accordance with the Omani Law and comparative legislation.
The following subjects are covered by this study:
A.) Definition of an electronic business premises and its distinctive characteristics, B.) Determining the legal nature of the electronic business premises, C.) The most important elements of an electronic business premises, D.) The method, at which, a contract is maintained through the electronic business premises, E.) The legal coverage to some impotent elements of the electronic business premises and the commercial transactions data through it
The study is divided in to introductory, first and second chapters. Introductory chapter is devoted to discuss the concept of traditional business premises; First chapters is devoted to discuss the concept of electronic business premises; Second chapter is dedicated to study the way in which a contract is concluded though the Electronic business premises and the legal coverage.
The objectives of this study is to attain the following conclusions:
(1). The electronic business premises consist of a set of funds that is intended for investment through the e-commerce. And the approach is intended to be in parallel with the traditional business premises in terms of legal nature and commercial exploration. (2). The electronic business premises consist of a set of elements. The most substantial of which are: the domain name, the side housing contract, the customers? component and the trademark of the electronic business premises. (3). There are no acts regulating the electronic business premises in the Sultanate of Oman and the comparative legislations. Therefore, it is necessary to have an urgent formulation of these legislations.
