English abstract
Work injuries suffered by the worker and the compensation for it, has became a problem which
worried lawmakers for many years , therefore , the most important aims of this research is to
study and analyze the work injury and to indicate the legal basis for compensating the injury ,
Therefore the main issues of this research are, analyzing the legal concept of the work injury, the
adequacy of civil liability rules in compensation for work injuries, explanting the idea of the an
inexcusable mistake ,the comparative descriptive analysis method was followed , through the
analysis of jurisprudence opinion and judicial efforts and compare what the Omani legislator has
taken with the texts of the converging Arab legislations in this regards ,Moreover this research is
deviated to three chapters as follow ; chapter one: the concept of work injury and the legal basis
for compensating the injury , chapter tow : application of the rules of civil liability in
compensating work injuries , chapter three: absence of the employer liability due to the worker
inexcusable mistake. One of the most important results of the research is that the Omain
legislator expanded the concept of work injury since the injury due to stress and fatigue was
included, the legislator also discussed the concept of road accident and its standard ,as the the
legislator set a basic standard for road accidents ,which is the standard of the natural road, the
research recommends following the approach of modern legislation, which focuses on
taking preventive measures to provide protection for workers and avoid getting
occupational diseases by conducting a periodic medical examination.
