English abstract
To abide by the terms of a contract is the sole objective for contracting.
Yet, it is understandable that along the course of this commitment,
unforeseen circumstances may arise and get in the way of a full
commitment. Such are coercion and the very description of the contract
abidance, concerning the contracted terms and its period. Fiqh in Islam has
provided a detailed account on the former and the Law has delineated the
latter. The study has identified a powerful role for coercion on abidance. The
study also shed light on a number of factors surrounding this force of
abidance including its types and where it crosses lines with exceptional
coercion forces and regular ones.
The study has arrived at a number of intriguing findings concerning the
level and types of abidance forces. A key finding in this study is that
abidance descriptions are found to be associated with certain factors that
lead to commitment and factors that lead to breaking out of contracts due
to inability to commit to the terms and conditions of the contract. In light of
these findings, a number of recommendations are put forward as part of the
concluding chapter.
