English abstract
This study thoroughly discussed the administrative body`s for administrative act in the Omani
legislation. It also focused on conducting a comparative study with the Egyptian legislation on the same
subject matter. This came in light of the juridical applications results presented to the Omani
administrative judge compared the abovementioned countries as well as in accordance with the
legislations regulating this responsibility.
The objective of the study is to stress upon the importance of the state's responsibility in the
legislated administrative works, especially in terms of protecting the rights and freedom of individuals.
It also aims to assert on this responsibility to align with the consequences of the scientific, economic and
political developments witnessed today. Additionally, the advantages and opportunities gained by
individuals through this responsibility is a main objective of this study as well.
The problem of the study arises in the task of identifying the main foundations and resources that
establish this responsibility. It also should address the cases that are deemed to be a valid
implementation of it. Additionally, it will highlight and compare the status, discuss the most imminent
applications of this responsibility and analyze and showcase the evidence and justifications deciding the
acceptable and rejected cases of this responsibility between the Omani judiciary and Egyptian judiciary.
The subject of the study was addressed in two chapters: the first chapter addressed the regulations
of the state's responsibility on its legislated administrative works by focusing on the main derivative
sources of this responsibility. The chapter also demonstrated the fundamentals, as well as the pillars which
are different from the responsibility based on errors made by the state, justifying the state responsibility
herein, be it primary or secondary.
On the other hand, the second chapter highlighted the main cases reflecting the state's
responsibility on its legislated administrative works. Moreover, it studied the application of such cases in
the Omani as well as the compared administrative jurisdiction. At the end of the study, conclusions and a
number of recommendations were provided.
