English abstract
The study discusses the attestation’s conditions on the divorcee’s return. That is attributed to this subject’s significance in terms of returning marital life bond and the results of that action; such as, the impacts that do not only affect the couples, but it also impacts the society. Since the Omani personal status law has a different view in this regard than the one of Islamic scholars, this study is conducted sets bases for this legal opinion, explain the extent to which its’ right in terms of outcomes, endeavors and Sharia policies. This study explores three themes. In its first theme, the study discusses concepts of “Ish’had” and “Raj’ah”; “attestation” and “divorcee” return. It discusses how scholars think of its significance and role in defense against accusations. Further, the second theme discusses the attestation rule on returning the wife. Thus, it detailed the commissioning ruling in terms of its standing and probability. The last theme points out to the conditions required for those to fit being witnesses. The study concluded with couple of findings and recommendations that the scholar is calling for in his study.
