Around the world, thousands of boys and girls are recruited into governmental armed forces and rebel groups to serve as combatants, cooks, or in other roles. Girls are also recruited for sexual purposes or forced marriage. Many have been recruited by force, though some may have joined because of economic, social or security pressures. Situations of displacement and poverty make children even more vulnerable to recruitment. These acts constitute a violation of the obligation on stats or armed groups to abstain from recruiting children and using them to participate actively in hostilities. Article 8 of the statute of the International Criminal Court states that: "Conscripting or enlisting children under the age of fifteen years into the national armed forces or using them to participate actively in hostilities", as a war crime.
This article is interested in the content and the source of the obligation and state responsibility, individual responsibility in the case of violation of concerned IHL rules.
