English abstract
The media is considered as one of the most important means that effectively contribute to establishing the principle of trial publicity as one of the most significant principles of fair trials. However, the media influence may exceed its objectives in a way that harms justice. Thus, to balance the necessity of the media presence as one of the components of publicity and the harm it may cause to justice, this research paper comes to suggest Solutions that may contribute to achieving the maximum benefit from the media presence with the least harm, by addressing the topic in three sections. The first of which means to address the principle of publicity and its development, manifestations, and effects, and the second section will focus on the role of media in trial publicity by examining the development of media throughout historical periods, its right to publish, and its impact on the course of justice, and the third section will propose guidelines for how media should approach the course of justice before, during, and after the trial. The study concludes with the results and recommendations, which the researcher deems fulfilling the purpose.
