English abstract
This study sought to identify the role of individual will in procedural law. Therefore, it employed the descriptive approach of analyzing legal texts in which the procedural law related the application of its rules to the will of the opponents and attempted to root these texts. The paper discussed the topic in two sections; the role of the individual will inthe Civil Transactions Law and the Procedural Law. The study concluded that individuals will is considered another source of the commercial and civil procedures law. To illustrate, some rules in the procedural law cannot operate to their full potential without the individuals deciding to do so; therefore, a legal rule may not have a legal function or use unless the party of civil or commercial litigation chooses to apply it. This makes the individual will a functioning source of the law, namely as the legislator has the major role in drafting the law and the judge's supplementary capacity regarding interpreting the law; it seems to be that the commercial and civil procedures law can also stem from the individuals will.
