English abstract
The International Humanitarian Law (IHL) along with its rules place major
restrictions on some types of weapons used in armed conflicts. Considering the development
and increasing use of drones in armed confrontations and military conflicts, it has become
made imperative to establish special legal standards that specifically control their possession
and military uses, as they frequently play notorious roles that go beyond the general
principles and norms of international humanitarian law. This is largely attributed to the
increasing frequency of its unlimited use in armed conflicts around the globe. For that, it has
caused many horrendous tragedies against civilians as well as heavy losses as a consequence
of targeting civilian sites. Hence the urgent significance of studying ways to mitigate as well
as limit these effects as a result of the rapid progress in smart weapons that are being
developed in an unprecedented manner and that drones operate with similar technical
algorithms. We firmly believe that the time has come to review their legality and evaluate
them more accurately and with a serious and more responsible legal outlook. In formulating
this research, I followed the descriptive inductive approach which is perfectly compatible
with the nature of this topic and its study.
Through our research and study into the legality of the use of drones, we came to
the conclusion that drones have become an important weapon in modern conflicts, that they
have caused many forgotten serious violations due to excessive and unaccounted use and
that compliance with the principles of International Humanitarian Law is one of the dire and
urgent necessities that must be possessed and adopted by the parties to the any conflict.
In addition, I strongly recommend that the international community shall work hard
to take a steady stance calling for the enactment of legal legislations prohibiting and
categorizing the use of drones in a way that totally preserves humanity’s rules and principles.
With that said, due to the use of drones, it has become a source of concern for the highest
humanitarian norms, not to mention that I also recommend the necessity of forming a body
affiliated with the United Nations which shall be entrusted with conducting investigations
related to this matter.
