English abstract
The study aims at defining the national and international guarantees and mechanisms related to human rights; either the substantive and institutional sides or procedural and applied sides. These aspects are of interest to a large proportion of intellectuals, in particular the defenders of human right issues. They enable intellectuals to deal with international and regional institutions and organizations if they fail to obtain those rights and freedoms by the national institutions and organizations.
This was dealt with through answering the following questions: 1. Definition of human rights concept; and the possibility of using them to get legal protection. 2. Various dimensions of legal protection of human rights and its mechanisms in the international and national laws? To answer these questions, we researched through a number of laws that dictate human rights in Islamic law Sharia, man-made laws that are shown through global declarations and international and regional conventions as well as national constitution and other legislations that are abided by in the Sultanate. Then, we sorted these into their subjects and split them into three chapters. In the first chapter, we defined human rights. In the second, we go through human rights protection in the international law. In the last one, we assigned the protection of human rights in the Omani law. We reached a number of conclusions at the international, regional and national levels. Most prominent of which are: 1. The importance of enabling the role of the national committee of human rights and the constitutional protection through the legal organization that is concerned with controlling the constitutionality of the laws and legislations. 2. Enabling the educational organizations one of which is the Law College at the Sultan Qaboos University to set up a program to study human rights. 3. Setting up an international court for human rights that is linked to the United Nation's, as well as other organization for the members of the Arab League. Add to this, a court or committee that is linked to the GCC with mechanisms similar to other regional courts and committees.
