English abstract
In this study I explained what the medical business required, its concept, types, origins, and its evolution through the ages. Also the concept of human organs, its types and the historical development of transfusions and organ transplants and the position of Islamic law, as well as the basis of criminal responsibility for these operations, whether among the living or the man deceased to another neighborhood.
The researcher have trod approach inference certain provisions contained in the Code of Practice of Human Medicine and Dentistry of Oman which related to the subject of study. The laws transfusions and organ transplants was taken from the United Arab Emirates, Egypt, Jordan, and some of the provisions contained in the Omani Penal Code related to this study.
The study concluded some important results: the most important result is the lack of legislation in Oman regulates transplantation of human organs. These processes take place in the Sultanate in general hospitals is not specialized and nonspecific. It is important to have a cadre of medical specialist to carry out such operations and the shortfall that we have observed in some of the legislation that mentioned before.
Accordingly, the study was able to produce proposals and recommendations and the results we hope to contribute to the development of the legal work in the area of transplantation of human organs with our preparation of the proposed legislation specialist.
