English abstract
This study addresses compulsory arbitration in the Sultanate of Oman. The researcher analyze what the Omani legislator set for this type of arbitration in a comparative study with the Egyptian law.
The research starting by analyzing the legal nature of compulsory arbitration. Also, the research clarifies the importance of constitutionality of compulsory arbitration, in the light of the Basic Statute of the Sultanate of Oman considering the famous decision of constitutional high court in Egypt.
The study explore the provisions of compulsory arbitration in the Sultanate of Oman, determining types of disputes might be settled by compulsory arbitration. Disputes concerning Telecommunications Law, Capital Market Law, and Mining Law are the main cases of compulsory arbitration in Oman. The research will consider the disputes in Telecommunication and capital market field sectors. The study comes to conclude exploring the effectiveness of compulsory arbitration as a means of dispute settlement in the Sultanate of Oman" through addressing the following issues:
1. The concept of compulsory arbitration under the Omani law.
2. The effectiveness of the plea of unconstitutionality of compulsory arbitration
considering the current status of the Omani law. 3. Distinguishing the cases of compulsory arbitration in the Sultanate of Oman.
