English abstract
This desertation aims to achieve an accurate understanding of the legal texts which govern the bankrupted debtor actions during the period of suspicion; in order to reach a comprehensive statement for these actions and judgments and its implications for all parties.
As a result, and in order to achievethe desired goals, it is important to get answers to several related questions and inquiries, including:
1. What is the historical dimension for bankruptcy provisions, in particular, the
bankrupt dealer's actions during the period of suspicion in the Omani legislation?
2. What is the sense taken by the Omani legislator for a period of uncertainty? What is
the sense designed by the Omani judiciary and legislator for the concept of stop payment?
3. What is the direction taken by the Omani legislator in determining the period of
uncertainty in which the bankrupt debtor conducted the business actions? What is the difference between it and the compared Arab legislations?
4. What are the actions subject to the lack of mandatory access provisions set by the Omani
legislator? Is it possible to expand in their interpretation and measurement or not?
5. What are the actions subject to the lack of permissible access provisions? What are
the differences contained in this regard between the Omani legislation and the Arab legislations?
All these questions and inquiries attached to them will find - with God's help - sufficient answerers coupled with judicial provisions and principles set by the Omani judiciary and the Compared judiciary.
The research was divided in a mannerfrom which we can guarantee taking its topic and associated and related issues to three chapters, the following two chapters are submittedincluding an introductory chapter to examine the suspect period nature. Thefirst chapter is allocating the Lack of mandatory access provisions of the dealer bankrupt during the period of uncertainty, and the second chapter is dealing with the lack of permissible access provisions for these actions. At the end of this thesis, the researcher reached several results and important recommendations.
