English abstract
This study discussed the Conscience Conviction of the Penal judge within the Omani legislation after considering it the main principal of the Penal claims, since it became the direct instrument of achieving Penal justice according to the intention of the legislator.
This study exposed the conscience conviction in light of the Omani legislation decisions, certifying the method subjectivity of this fundamental principal to reach to Penal judgments revealing the truth and hold its address.
This study revealed the principle concept from its different aspects and stopped afterwards to detail about the relation with the judicial certainty. Then dividing two independent chapters for the requirements and regulations according to the conscience conviction of the Penal judge, based on which we can determine the matching range of this conviction with the will of the Penal legislator
