The law exists in countries to protect the rights and freedoms that every individual living within the geographical boundaries of the state is supposed to enjoy. Penal law, in particular, punishes those who violate the rights and interests of others. With the rapid developments in the world, behaviors that contradict the values, principles, and laws of society have emerged. Thus, penal law is well-suited to address any actions that may disrupt the security and stability of society. In light of this, and based on our observations of societal realities, the act of "takhbib" has recently become more prevalent than before. This may be due to several reasons, the most significant being the technological revolution and the considerable openness in social media. However, legislative measures to address this act have been very limited in several countries. Therefore, this research aims to inform the reader about the meaning of "takhbib," its legal ruling, and the severity of its consequences. The importance of this research lies in the necessity to keep pace with the legal developments occurring in society and to confront them through the law. The research problem centers around the extent to which society needs to establish a legal text that criminalizes the act of "takhbib." We adopted an analytical approach in this research, analyzing the act, its components, effects, causes, and related matters. We also employed a comparative method by presenting the legal experiences of countries that have addressed this act. In conclusion, we reached several findings, the most important of which is the reality of the act of "takhbib" in the Sultanate and its resultant effects. We recommend, at the end of this research, the necessity of addressing the legislative gap and establishing a penal text that criminalizes the act of "takhbib" and punishes its perpetrator.
