As a result of the technological development in all aspects of life, it has become easy to access information and images, including storing, processing, and modifying them. However, this amazing progress has been accompanied by the development of criminal thought, which has led to the production of new types of criminal behavior. Therefore, most criminal legislation has worked to provide legal protection, as a result of the emergence of a new type of evidence in the field of criminal proof, called digital evidence, as new evidence in the field of criminal proof, and of a complex technical nature. For all of the above, digital evidence poses a pivotal problem, which is essentially the extent of the validity of this evidence before the courts? What is its impact on the discretionary power of the criminal judge? The importance of this study revolves around addressing the issue of the authority of digital evidence in criminal proof in Omani law, in the absence of clear legal mechanisms, starting with defining its concept, the means of searching for it, preserving it, and explaining its authority in criminal proof, in accordance with legal frameworks that clarify and protect legitimacy. It is worth noting that the technical aspect is constantly evolving, while the legal texts have remained unchanged, as traditional texts are no longer able to address issues related to criminal proof with digital evidence. Moreover, the importance of adopting electronic alternatives lies in modernizing the justice sector, keeping pace with technological development in the field of criminal proof, and contributing to preserving evidence and not hiding it through innovative methods. The issue of the legality of digital evidence has generated widespread controversy in the arena of jurisprudence and criminal law, especially with regard to the validity of this evidence, and its replacement of conventional evidence. The importance of the subject also appears in the fact that it has not been addressed in-depth and sufficiently in previous studies in Omani law, which makes it need more research and study.
