This study deals with the subject of the provisions of preventive
composition from bankruptcy in the Omani legislation - a comparative
study, because of the great benefits of this topic in the practical reality
for its parties, whether those benefits are placed on the side of the
debtor merchant who seeks reconciliation on one side or the creditors
who hold rights in another aspect, in addition To the reflection of
those benefits on the state in advancing the economy. In the
introductory chapter of this study we have dealt with a statement of
what is meant by bankruptcy, the legal conditions necessary for it and
the accompanying effects, and a statement of the similarities and
differences between it and the system of conciliation protection from
bankruptcy so that the aforementioned matter is an introduction to the
subject of the study, and then the discussion in the first chapter about
what reconciliation is The protector of bankruptcy as for the second
chapter, a statement of the effects of preventive composition from
bankruptcy and its expiration was dealt with. Finally, the researcher
concluded with a conclusion that included with the results and
recommendations that had been reached.
This study will end with that the bankruptcy protection
arrangement is a system for merchants whose provisions aim to
avoid the risk of bankruptcy of the troubled debtor trader in his
financial business. Through it, the debtor trader can avoid his
bankruptcy, and in return, creditors can recover their rights without
resorting to complicated bankruptcy procedures, which is what in
turn, it reflects on the state in reducing bankruptcies that may effect
on country's economy.
