The issue of electronic monitoring using the electronic bracelet is one of the modern topics related to criminal justice, which has become imposing itself in the human rights and legal debate at all levels. It is based on adopting mechanisms and means that would achieve the criminal punishment for its purposes, including reforming the convict and reintegrating him socially without harming him. With the presumption of innocence, and for this reason; the electronic monitoring mechanism has been developed using the electronic bracelet as a means of implementing criminal punishment. On the other hand, it keeps pace with technical and technological development, and it seeks to achieve the purposes of punishment by contributing to reducing the rates of increasing crime in society. Therefore, this study came to study the legal system of electronic monitoring using the electronic bracelet as a modern means of punitive enforcement and the extent of its seriousness and usefulness in treating cases of criminal recidivism. Moreover, it investigated the problems of overcrowding in prisons, and in reforming convicts. The study addressed the position of the Sultanate of Oman regarding electronic monitoring, and the researcher relied on it in her research. Descriptive and analytical approaches were implemented in order to analyze the system of being placed under electronic surveillance. The study reached a set of results, the most important is that the system of being placed under electronic surveillance is a consensual method that takes into account the humanity of the convict, and aims to rehabilitate the convict and integrate him into the surrounding society. The researcher recommended to the Omani legislator the necessity of adopting the electronic monitoring system as a means of punitive implementation, especially for short-term punishments. The study also recommended making the necessary amendments to the Omani Criminal Procedure Law regulating the use of electronic monitoring, approving it as a penal punishment or as an alternative to pretrial detention, and the need to prepare society for this.
