English abstract
The aim of the research is to compare between the Omani and
Egyptian legal texts regarding the resposibility of the supervisor and the
regulations governing it. It elaborates on the nature of the supervisor's
responsibility, the basis upon which this liability is founded, how it can be
negated, and the necessary conditions for its establishment. The research also
addresses the right of recourse for both the supervisor and the supervised
party regarding compensation, concluding with several key findings: The
supervisor's obligation stems from the law or agreement, The basis of the
supervisor's liability in Omani law is presumed fault, The supervisor may
negate liability by proving the performance of supervisory duties or by
negating causation, The supervisor in Omani law is consistently responsible,
The researcher recommends that Omani legislation follows the Egyptian
approach where the supervisor is considered primarily responsible when the
supervised party is not discernible. Additionally, the researcher suggests that
criminal laws should address the supervisor's liability to increase their
vigilance over those under their supervision.
The researcher approached the topic in two chapters, opening with a
chapter titled "The Concept of Supervisor Liability for Whom Supervision Is
Required." The second chapter delves into the basis and establishment of civil
supervisor liability and how it can be negated

هدفت الرسالة إلى عمل مقارنة بين نصوص القانون العماني والقانون المصري فيما يتعلق بمسؤولية متولي الرقابة والأحكام المنظمة لها حيث تطرق إلى توضيح ماهية مسؤولية متولي الرقابة والأساس الذي تقوم عليه هذه المسؤولية وكيفية نفيها والشروط اللازمة لقيامها.
