English abstract
In the introduction, the research highlights the general
provisions of the issue including the definition, its origin, concept,terms
and conditions as well the moral and physical elements of the crime.
The first chapter addresses objective practical problems including the
nature of some cheques as being guarantee cheques, the issue of
payable balance and newly immerged forms of cheque offences under
the new Penal Code.
The second chapter examines procedural issues especially complaint
process and the abatement of criminal proceedings due to payment and
waiver of the claim.
The study adopts a comparative analysis approach to compare between
the Omani law and other laws in Arab countries and examines some
legal texts to arrive at its rationales, interpretations and ultimate
purposes envisaged by the judicature.
