English abstract
This study dealt with the civil responsibility of judges and members of the Public
Prosecution, as it dealt with texts related to them in the Omani Civil Transactions Law
and the Law of Civil and Commercial Procedures, and in some comparative procedural
laws, analysis, interpretation and comparison, in order to find out some important
aspects, which clarify the position of the civil legislator regarding those acts Which he
determined exclusively and produces harm to others, and how to deal with it.
This study has shown the basis of the state's responsibility for the acts committed by
judges and members of the public prosecution being a follower and the last one
continued, through research and study of theories and judicial rulings that were said in
establishing the responsibility of the follower for the actions of his subordinate, leading
to the demand for compensation for damages caused to others.
The importance of the study appears as well as it examines one of the important issues
related to protecting the rights of those dealing with judicial facilities. The study
emphasized the implementation of that right in the Sultanate of Oman, with a set of
proposals for the legislator to take it into account when organizing that right in
accordance with the means available to the judiciary to make it into effect.
This study also comes as an attempt to shed light on this right, which was stipulated in
the Omani Civil and Commercial Procedures Law in terms of paying attention to the
development of the right of the judiciary in this regard. Moreover, members of the
Public Prosecution and how to initiate a litigation case.
